Some prominent federal laws pertain to ELLs with Disabilities
Title I of the Elementary and Secondary Education Act (ESEA) of 2001
Title I requires public accountability for the education of all students, including students with disabilities.
Students with disabilities must participate in large-scale assessments intended to measure achievement relative to grade-level academic content standards.
To participate in large-scale assessments, ESEA requires that students with disabilities are provided reasonable adaptations and accommodations.
Title III of ESEA
Title III of ESEA supports quality instruction in English and grade-level academic content for ELLs.
Title III requires states to develop standards for English language proficiency that are linked to academic content standards. ELLs are annually assessed for English language proficiency.
Title III also requires that ELLs be included in large-scale assessments measuring student achievement relative to grade-level content standards.
